There must be some relationship. No record of him inheriting or buying land from John has been found. However, he did have land of his own. His children Phelix, Thomas, Henerich and John are listed in land sales from his estate. Thomas was not in the 1800 census but a Priscilla Blackston was with children that would be consistent with the 1790 census of Thomas Blackston, she may have been his widow. |

Since Warren listed Joel and Sallie Braxton as his parents in his Marriage Record to Cennetta Tripp, we know that Warren was the son of Joel and Sallie Braxton. In an 1836 deed, Joel identified Phelix as his son; therefore, we know that Phelix and Warren were brothers. We also know from Phelix's Will that James, who had moved to Florida, was his brother. From letters James wrote from Florida, we also know that their sisters included Elizabeth Braxton Smith and Mary Braxton. In a Dower Deed dated this day, Warren and Cennetta "agreed to live separate and apart". The deed is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book P5, Page 235 and reads as follows: "Show all men by these promises that in consideration of eleven acres of land this convance to me by Warren Braxton as per the deed for that land doth appear I do hereby release all my right title and interest in and to my dower right of the lands of said Warren Braxton and my rights in law to the personnal property of the said Braxton and I hereby further relieve the said Warren Braxton from all support or maintenance of myself. We agree to live separate and apart from each and not to be bound for any debt I may contract from this date. Witness my hand & seal This August 20, 1886 Cennetta "X" Braxton I hereby agree to the foregoing and consent that Cennetta may sign the same. Witness my hand & seal August 20, 1886 Warren "X" Braxton" From a review of other records, it does not appear that they remained apart very long. Warren and Cennetta continued to sign deeds together through 1887. On December 19, 1893, in the Special Proceedings of the Pitt County Superior Court, (Book 2, Page 182), Cennetta filed a petition for Dower Rights which was unopposed by Warren. It was approved on January 1, 1893. Cennetta also bought the balance of Warren's estate after he died in 1898. Finally, the inscription on her tombstone from 1899 reads as follows, "Sennettie, Wife of Warren Braxton." At the time of these proceedings, a Dower was the amount of an estate that a widow was entitled to upon the death of her husband. Under common law, in the late 1800s, one-third of a man's estate went to his wife. .17 |

| Burial* | Family stories tell us that Warren's body was interred in 09/__/1893, in the Ben Byrd/Cox Family Cemetery; on Reedy Branch Road approximately 1/2 mile west of Winterville, North Carolina and purchased by Kenny G. Braxton in 2003. If this is the true, he is buried in an unmarked grave. In a cemetery transcription completed by Jeannette Cox and published in 1962, it was noted that at the time, there were 13 wooden slabs and evidence there had been more. .19,20 |

Containing fifty acres which tract or parcel of land I warrant and defend the right to be good to him the Said Warren Braxton and his heirs & asigns against the lawful claims of all persons whatever. In witnef whereof I set my hand & seal in the presence of Eleayas Ellis, Stephen Nobles. Phelix Braxton " We can assume from this record that Warren must have been at least 21 at the time of this Deed and from this we know he was born before January 30, 1824.21 |

| Census 1850 - free* | On 10/07/1850,Warren was listed as the head of a family on the 1850 Census at Burney's District, Pitt County, North Carolina. The following entry was made for Warren and his family: Warren, age 27, farmer; Sarah (Cox), age 31; Christopher C., age 4; John J., age 3; Martha Braxton, age 15. Martha is too old to have been Warren's child; she may have been one of his two younger sisters. From the 1840 Census, we know Joel and Sallie had a daughter that could have been 15 in 1850. Warren's other younger sister may have been the Mary who was living with his brother, Phelix, during the 1850 Census. Neither Warren nor his wife, Sarah could read or write. The real estate he owned was valued at $1,111. From a complete review of all of Warren's deeds, we know that at the time of this Census, he owned at least 50 acres. In fact, the amount could have been significantly more because in a deed dated September 26, 1846, in which Warren bought land, the acreage was not recorded. His household was recorded as number 804 on Page 49A under the Burney's District. .3 |
| Deed* | Warren and his wife were recorded as heirs to property located at Swift Creek, Pitt County, North Carolina, on 03/22/1851. There were two deeds executed on March 22, 1851. The first deed was for the sale of John Cannon's estate to his brother Thomas Cannon and the second deed is where all of the parties below agreed to give up their rights to the land as heirs for a share of the proceeds. The estate was located on the northeast side of Swift Creek near what is today Ayden, North Carolina. This land adjoined Thomas Cox and Joseph Cox's land and sold for $266. This deed is recorded at the Pitt County Courthouse in Greenville North Carolina in Deed Book NN. Page 22. The following individuals were heirs and parties to selling John's land to his brother, Thomas Cannon: Hillery Cannon, his sister; Catherine Slaughter, his sister; Benjamin Tripp and wife Sarah, his sister; Caleb Cannon, his brother; Robert Worthington and wife Mary, his niece; William Hart and wife Mary, his niece; Henry Cannon, his brother; John C. Cox, his great nephew; and Warren Braxton and wife Sarah, his great niece. .25 |

The land was located near Swift Creek, Pitt County, North Carolina adjacent to Joseph Ringold's, Benjamin Tripp's, and Joab Herrington's and others land. The deed reads as follows: "....adjoining the lands of Joab Harrington & others, Begining at a Black Gum on Cedar Swamp near an Ash said Warren Braxton's corner & runs up the run of Cedar Swamp to some Bayo said Tripp Corner thence with his trail up slash to pine pond, thence on the edge of said pond to a black gum, thence South 10 degrees West 90 pole to the head of another slash, thence with that slash to a Large poplar on the side of Swift Creek Swamp then up the edge of said swamp to a Cypress in Joab Harrington line then north 30 degrees east so the begining and another piece in swift creek swamp, begining a sweet gum on the same side of the swamp and runs west across the swamp seventy two poles to another gum in his mouth of Persimmon Branch there east 70 pole across the swamp then down the edge the swamp to the begining. Both tracts containing two hundred thirty seventh acres more or less...." .27,28 |

His military record contains the following information: He was a 40-year-old farmer and residence of Pitt County North Carolina, when he enlisted as a Private in Greenville, North Carolina. 1.) On March 3, 1862 he mustered into the infantry unit, Company "I" 44th Regiment North Carolina Troops. During the war, the North Carolina 44th Infantry incurred a total killed of 36, 198 wounded, 444 captured, and 3 missing out of a total membership of 1,507. 2.) On March 3, 1862, he was mustered into his unit at Camp Magnum near Raleigh, North Carolina. He was recorded as being 5' 9". He enlisted for 3 years or the duration of the War. 3.) On March 20, 1862, he was recorded as present in Greenville, North Carolina, he was owed a $50 bounty and salary since enlistment. 4.) On January 27, 1863, he was recorded as being present at Company I 44 Regiment North Carolina Troops. 5.) On August 31, 1863, he was last paid. 6.) On October 8, 1863, he was recorded as being in the 3rd Division General Hospital at Camp Winder, Richmond, Virginia. He was issued clothes on this day. 7.) In November and December 1863, he was recorded as absent in the muster rolls of Company I 44 Regiment North Carolina Troops. 9.) No other records. Warren's unit, 44th Infantry Regiment, completed its organization in March 1862, at Camp Mangum, near Raleigh, North Carolina. Its companies were recruited in the counties of Granville, Edgecombe, Pitt, Chatham, Montgomery, Beaufort, and Franklin. It served in the Department of North Carolina, and then was assigned to General Pettigrrew's, Kirkland's, and MacRae's Brigade, Army of Northern Virginia. En route to Gettysburg, the 44th stayed at Hanover Junction to guard the railroads. Later it fought at Bristoe, The Wilderness, Spotsylvania, and Cold Harbor. It was then involved in the Petersburg siege south of the James River and the Appomattox Campaign. The regiment reported 23 killed and 63 wounded at Bristoe, sustained heavy losses at The Wilderness and in front of Petersburg, and surrendered 8 officers and 74 men on April 9, 1865. Warren must have been fairly well off. If you use this agricultural census as a basis, on the page Warren's farm and assets are listed, there are 39 of his neighbors listed. The next highest value to Warren's $16,500 is $5,800. His brother, Phelix, assets are valued at $1,050 and the average for his 39 neighbors was $947. In today's dollars, $16,500 in 1870 is worth approximately $200,000 in 2000. One thing that cannot be explained from the entries in this Census is why the value of his farm production and betterments were worth so much more than the sum of the itemized values in the Agricultural Census and the value of his personal estate listed in the Population Census. These totaled $1,960; yet his estate was valued at $16,500. What constituted the $14,540 difference? Could Warren have had some type of business on his farm? If he did, what was it? Saw mills, a grist mill, turpentine processor.... We will probably never know. Warren's farm was recorded as the twenty-third farm and the twenty-first farm belonged to his brother, Phelix.36 |

The land was described as having been owned by John Tripp who obtained it from his father, Hardee Tripp, and the land was known as Arthur Tripp Land. John Tripp was the brother of Warren's wife, Cennetta, Hardee Tripp was Cennetta's father and Arthur Tripp was her grandfather. Not a bad deal for the Braxton family considering Warren borrowed $882.87 three years earlier from W. F. Kornegay against the land. It is not known why Warren did not repay the loan. | Court - civil* | Court action was taken regarding Warren Braxton's estate at Pitt County, North Carolina, on 09/16/1893. This started a long drawn out court battle that was not totally resolved until almost six years later on July 27th 1899. In summary, Cennetta petitioned the Pitt County, North Carolina Superior Court to restore her dower right in two tracts of land that her deceased husband, Warren Braxton, had owned. One tract contained 54 acres more or less and the other contained 90 acres more or less. In the December 1897 Term of the Superior Court of Pitt County, her claim for the 90 acres tract was stricken from her petition for dower by decision of the presiding judge. In the April Term 1889 of the Pitt County Superior Court, it is recorded that Cennetta purchased the 54 acre tract at public auction and the dower case was "ordered adjudged and decreed that plaintiff is the owner in fee." She died less than a year later on December 31, 1899. The following transcripts are from the original documents recorded at the Pitt County Courthouse in Greenville, North Carolina. On September 16, 1893, a Widow Year's Support Report of Commissioners was completed and submitted on Nettie W. Braxton. A transcript of the document follows. "State of North Carolina, Contentnea Township, Pitt County: IN THE MATTER OF Nettie Braxton, WIDOW, REPORT OF COMMISSIONERS. THE UNDERSIGNED J W Smith, a Justice of the Peace, and James F. | Estate Division* | On 12/10/1898 the Superior Court of Pitt County issued the following decree regarding the estate of Warren. In accordance to the order issued by the Superior Court of Pitt County Jesse Cannon, administrator for the estate of Warren Braxton, deceased, sold part of Warren's estate at public auction on January 12, 1899. Cenetta paid three hundred dollars for these 59 acres, which appears to have been the last of the land owned by her husband, Warren Braxton. His home place may have been located on this land. This deed is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book R6, Page 41-43. The land was described as: "...adjoining the lands of Fred McLawhorn, the Sam Manning land, and others, containing fifty-nine (59) ares more or less..." .18 |

| Biography* | The following summarizes our interpretation of the information we have found thus far about Warren and his family. 1.) Warren recorded Joel and Sallie Braxton as his parents when he and Cennetta Braxton recorded their marriage on August 15, 1877; they were married the following day. He was 55 and she was 33. 2.) In 1851, Warren owned at least 600 acres of land and in 1874, he owned at least 747 acres. All of his land holdings were in Pitt County, North Carolina. During his lifetime, he either bought or sold land 31 times. When he died in 1898, including the 250 acres he held in a life estate, he owned or controlled 465 acres of land. 3.) Most, if not all, of the land he owned was located near where the Swift Creek crosses the old Greenville-Kinston road. In 27 of his 31 deeds, his land is described as being in, or on, or adjoining Swift Creek. It was at a point where Swift Creeks runs North to South, and then turns and runs East to West before returning to its normal North to South flow. These conclusions are based upon review of Warren's deed in which it is recorded that he owned land on the East, West, North, and South sides of Swift Creek. This happens at two different locations. One is on the West of side of Winterville between Winterville and Ayden near new highway 11 and the other is on the East Side of Ayden and slightly south. Both areas are within a mile or two of Winterville and Ayden. The point on the West Side is near the Ben Byrd cemetery. The point on the East side is near Redalia. It is also noted in a deed dated, January 29, 1887, that his land adjoined the Greenville-Kinston road. In addition, it was noted in deeds that his land was adjacent to the mouth of Swift Creek Swamp, in several deeds the land was adjacent to Cypress Branch, and in at least one deed it was noted that his lands were adjacent to Cedar Swamp. 4.) Several other factors lead me to believe that Joel's, Warren's, and Phelix's land was in the Winterville-Ayden area. The only recorded deed of Joel buying land is in 1835 when he bought 100 ½ acres on the West Side of Swift Creek. He gave this land to Phelix in 1836. In 1845, Phelix sold one-half of this land to Warren. From a review of all of Warren's deeds, this was the first land he owned, it was most likely eventually combined with future land purchases, and perhaps it was where his home place was located. 5.) From the 1870 Census, we know that Warren and Phelix continued to live close to each other throughout their lives. Another person that the 1870 Census helps link Warren to the Winterville-Ayden area is John C. Cox, the brother of Sarah Cox, Warren's first wife. In the 1870 census, Warren's farm was recorded as #86, Phelix's was #70, and John's was #67. 6.) Phelix was a member of Reedy Branch Church and in his Will, he left money to the Reedy Branch Church. Phelix's wife, Sarah, is buried less than a mile West of Winterville in the Ben Byrd/Cox Family Cemetery beside of Warren's son and daughter-in-law, CC and Sarah Braxton. John and his wife Elizabeth are also buried in this cemetery. With the only mode of transportation being a horse and buggy, people simply did not travel far from home with any frequency. In their day, people did not attend church very far from home and were generally buried near their home. 7.) However, the 1880 Census does create some confusion. Although Felix and John still own adjacent farms and their information is recorded on page 40 of the 1880 Census, Warren's information is recorded on Page 27 of the same Census Book. Has Warren moved or has the Census taker entered farms in a different order than they were entered in 1870? 8.) Another factor that links Warren to Ayden is that many of Warren's deeds described his land as being adjoined by Joab Harrington's land and in some instances, Joab either witnessed Warren's deeds or Warren witnessed Joab Harrington's deeds. In researching another branch of our ancestral tree, we discovered a deed from our great great grandfather Skeleton Dennis where he gave land to the Spring Branch Church to build a new Church. This church was located beside of the Dennis Cemetery on the West Side of Ayden less than a mile from the Ayden Elementary School. This is where the church was located for many years until it moved to downtown Ayden and changed its name to the Ayden Free Will Baptist Church. Joab Harrington, as a deacon of the church, signed the deed on behalf of the church in 1890. Just as Phelix must have lived near Reedy Branch Church, Joab must have lived near the Spring Branch Church.7,13,15 |

Since Warren listed Joel and Sallie Braxton as his parents in his Marriage Record to Cennetta Tripp, we know that Warren was the son of Joel and Sallie Braxton. In an 1836 deed, Joel identified Phelix as his son; therefore, we know that Phelix and Warren were brothers. We also know from Phelix's Will that James, who had moved to Florida, was his brother. From letters James wrote from Florida, we also know that their sisters included Elizabeth Braxton Smith and Mary Braxton. Our 12 marker results were identical, which means our Most Recent Common Ancestor (MCRA) has the probability of occurring in the following timeframes: within 7 generations, 50% likelihood - within 23 generations, 90% likelihood - within 29 generations, 95% likelihood. The test results also indicate that we are both in the Haplogroup: R1b1b2. A Haplogroup is a genetic population group associated with early human migrations and which can today be associated with a geographic region. It is important to note that even though female and male haplogroups may have the same letters, their definitions are different. Haplogroup R1b is the most common haplogroup in European populations.
