Biography* After their father's death in 1894, their mother could not afford to keep all of the children. She kept the baby, Clara, and sent the rest to the Masonic Home for Children in Oxford, North Carolina. This orphanage opened in 1838.4 
Guardian Estate*On 11/25/1898 a decree was issued assigning a guardian for Patsy Bertha Braxton as a minor heir to an estate. At the request of Cennetta and Warren's adult children, W. F. Hart was appointed guardian for the minor heirs of Warren for the purpose of protecting their rights in the division of Warren's Estate.

The minor heirs were Rosa D. Davenport, Cesna (sp) Braxton, J .D. Griffin, Louisa Braxton, Melisia Braxton, Patsy B. Braxton, James A. Braxton, Celesia (sp) Braxton and Mary J. Braxton. This Court Order is recorded in Orders and Decrees Book 2, Page 492..7

Deed*Phelix was given property at Pitt County, North Carolina, on 02/29/1836 by his father Joel. This deed is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book LL, Page 510. Thus far, no other deeds have been found in which Joel is recorded as buying land. It is unclear why Joel deeded what appeared to be his entire estate to his son. From this record, it appears that perhaps Joel's health had failed and Phelix was going to look after Joel and his wife Sallie. However, fours years later, in the 1840 Federal Population Census, Joel is recorded as the head of a household that appears to include his wife Sallie, Phelix and his wife Sarah, Warren, and one other son and five daughters. Joel's name is spelled once in this deed as Jolly and twice as Joel. The deed is recorded as follows:

"Knows all men by these present that to whome it may come Greetings how it that I Jolly Braxton do for the consideration of the natural affection which I have and bears towards my son Felix Braxton have given into his on certain tract or a parcel of Land lying in the county of Pitt adjoining Joshua Nobles, Jonathan Kittrell line, Arthur McGlowhorn, containing one hundred
acres to the same more or less also all my stock of all kind cattle sheep Hogs Household furniture cart gear etc. To have and to hold the aforesaid property unto him the said Felix Braxton him his Heirs Encestors aliving as of signing forever and I the said Joel Braxton do warrant and defend the Rite and title of the above said property from the claims or claiming of all persons or person claiming by through or under me in witness where of I have hereunto set my hand & seal this 29th February 1836."

Deed*He sold property at Swift Creek, Pitt County, North Carolina, on 01/30/1845. Phelix appears to be selling his brother, Warren, one-half of their father's, Joel Braxton, estate that Phelix was given in 1836. The deed is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book LL, Page 292. This deed reads as follows:

"North Carolina 30th January 1845.
"Know all men by these presents that for and in consideration of the sum of one hundred and fifty dollars to me in hand paid by Warren Braxton, the receipt in hereof is hereby acknowledged, have bargained and sold to him the Said Warren Braxton a certain piece tract or parcel of land on the west side of Swift Creek and bounded as follows, begining at a frost oak and running a line of marked trees, Joshua Nobles line to a line in the center of a Pine, then west 25 pole to a frost oak then south 12 east 17 pole to a line thence South 55 West to an agreed corner thence with a line of marked trees to the begining. Containing fifty acres which tract or parcel of land I warrant and defend the right to be good to him the Said Warren Braxton and his heirs & asigns against the lawful claims of all persons whatever. In witnef whereof I set my hand & seal in the presence of Eleayas Ellis, Stephen Nobles.

Census 1850 - free* On 09/25/1850,Phelix was listed as the head of a family on the 1850 Census at Griffin's District, Pitt County, North Carolina. The following is a transcript of Phelix (Felix) Braxton's household from the 1850 Federal Population Census: Felix, age 35, was recorded as a farmer; Felix's wife, Sarah Ann Sutton, age 25, could not read or write; Mary Braxton, age 18. Mary is too old to have been Felix's child; she may have been one of his two younger sisters. Felix's other younger sister may have been Martha, age 15, who was living with his brother, Warren, during the 1850 Census. From this record, we know Felix was born in 1815 and his wife, Sarah Ann Sutton Braxton, was born in 1825. Neither of them could read nor write. The value of the estate real he owned was $379. His household was recorded on Page 36 under the Griffins District and his household was recorded as number 600.

Census 1860 - Slave*Phelix W. Braxton was recorded as a slave owner on 08/31/1860 in the 1860 Census Slave Schedule at Pitt County, North Carolina. He owned one black male slave, age 29 and one black female slave, age 8. She was recorded as a "Fugitive from the State". One slave house was recorded. His information is recorded in the 1860 Pitt County, North Carolina Slave Schedule on page 552. This record was recorded 2 days before his population census record was recorded and by the same census taker.13

His record was recorded as follows: Felix age 44, farmer and could not read or write. His wife, Sarah Ann, was recorded as SA, age 37. Felix estate was valued at $800 and his real property was valued at $2,000. A Gracy Tyson, age 22, also was recorded in Felix's household as "serving". His information is recorded in the 1860 Pitt County, North Carolina Federal Population Census on page 154 in the Coxville District.

By me summoned for that purpose according to law after being by me duly sworn & enpannelled at Robert WORTHTNGTON In the County aforesaid did hold an inquest over the dead body of Mary WORTHINGTON and after examination into the facts, & circumstances of the death of the deceased from a view of the corps & all the testimony to be procured, the said jury finds as follows that is to say that the deceased came to her death by drowning herself as she was not Saine.

The examination of Caleb WORTHINGTON taken before the undersigned Coroner of Said county, this 24 day of October 1880 at the House Robert WORTHINGTON upon the body of Mary WORTHINGTON there and then Lying dead to wit: Caleb WORTHINGTON being duly sworn and says my Sister came to the Gin House yesterday where I was at work and told me that mother the Deceased was missing and I immediately came to the House and tried to get on her track, Knowing that her mind was not rite. I hunted all along through the fields and could not find any trace of her until I came to the marl holes which is about five hundred yards from the house. When I reached
there I saw her in the marl holes face downwards thereupon I examined around the holes and could not find any other track but hers I then took her out of the hole and Brought her to the house with the assistance of Susan A CANNON.

Census 1870* On 08/09/1870, Phelix was listed as the head of a family on the 1870 Census at Contentnea Township, Pitt County, North Carolina. Phelix's age was recorded as a 55-year-old farmer and his wife, Sarah, was 45 and kept house. Phelix could not read or write; however, his wife, Sarah, could. A Sarah A. Stokes, age 13, who had not attended school in the past year and who could not read or write, was also listed in their household. She appears to be the Sarah Evans, age 22, recorded in Phelix's household in the 1880 Census and later identified in Phelix's 1886 Will as the niece of his wife, Sarah Braxton.

His record reads as follows: Improved Acres, 60; Wooded Acres, 158; Other Unimproved Acres, 40; Cash Value of Farm, $1,000; Value of Farming Implements and Machinery, $40; Value of total wages paid during the year, including value of board, $150; Horses, 1; Milk Cows, 1; Working Oxen, 1: Other Cattle, 6; Sheep, 20; Swine, 13; Value of Live Stock, $200; Indian Corn, 200 bushels; Ginned Cotton Bails, 4; Wool, 50 pounds; Peas and beans, 20 bushels; Hay, 3 ton; Value of animals including those sold to slaughter, $250; Estimated value of all farm production, including betterments and addition to stock, $1,050.18

 
Census 1880* On 06/24/1880, Phelix was listed as the head of a family on the 1880 Census at Pitt County, North Carolina. The following is a transcript of Phelix (Felix) Braxton's household: Phelix, age 65; his wife Sarah, age 55; Sarah Evan's, age 22; William, age 2. The latter two are identified in Phelix's 1886 Will as the niece and great nephew of his wife, Sarah Braxton. Sarah Evan is buried in the Braxton section of the Ben Byrd/Cox Family Cemetery near Phelix's wife, Sarah.

Deed*Phelix sold property at Pitt County, North Carolina, in __/__/1881. According to W. Terry Craft's article in the Chronicles of Pitt County Volume II, Phelix sold the land to Elias Craft.

Will*His Will was recorded on 07/03/1886 at Pitt County, North Carolina. Phelix's Will was presented to the Clerk of the Superior Court by his wife Sarah Ann Braxton. The Will had been written prior to his death according to the witnesses, John C. Cox and J.B. Carroll. The Will is recorded at the Pitt County Courthouse in Greenville, North Carolina in Book 2, Page 364. Phelix directs that 25 acres of his land be sold and the balance of his real estate and personal property to be left to his wife, Sarah Ann, and her niece, Sarah Ann Evans, who was the daughter of Sarah Ann Braxton's sister. After their death, the land is to be sold and the proceeds are to be distributed as follows:

"$50 to Reedy Branch Church in Pitt County and $300 dollars to my brother James Braxton's heirs now living in Floridy."


The balance to be divided equally among his next of kin with the exception of William Sathinghouse who will receive "50 dollars extra". One interesting aspect of his will is that one of the witnesses was John C. Cox who was Phelix's neighbor and the brother of Phelix's sister-in-law, Sarah Cox Braxton, wife of Felix's brother, Warren.6

 
Biography* Although Phelix's name appears to have been spelled both Phelix and Felix, the correct spelling must have been Phelix. His name was spelled Phelix in a deed of land in 1836 to him from his father Joel, in a deed of land from him to his brother, Warren, in 1845, and his wife's gravestone has her name recorded as "Sarah A. wife of Phelix Braxton...." She is buried in the Ben Byrd/Cox Family Cemetery beside of Warren's son Christopher Columbus and his wife Sarah Marena Griffin Braxton. We have not found any record of Phelix and his wife, Sarah, having children.2
