Psgr List*A John Blackstone was listed on a passenger list for the “Tryal” that left London, England either December 1749 or January 1750 and arrived at York River, York County, Virginia, in 03/__/1750. This is one possibility regarding John's linage. Another, is he was the son of James Blackston a relationship not yet proven. If we assume John did arrive from England in 1750, like many early settlers, he was guilty of some kind of petty crime and in lieu of time in prison, John was sentenced to servitude in America. Serious crimes such as murder, rape, treason, etc. were not commuted to transportation. The usual time of transportation was 7 years unless otherwise noted and those transported could not get married until their servitude was completed. Therefore, this John may not have married until 1757, so his eldest child would not have been 21 until 1778. I know from old English Sailing Records and Manifests that another John Blackston departed from London, after being sentenced in Middlesex, England, in either December 1749 or January 1750, arrived in America in March 1750. Unfortunately, the port of destination was not recorded. However, from a review of other records it appears the port of arrival was either Maryland or York River, Virginia. Most likely, it was York River. Today the town of York River is known as Yorktown and is located at the mouth of the York River near Williamsburg, Virginia. The following is a summary of his passage information as recorded in "The King's Passengers to Maryland and Virginia, 1718-1776," by Peter Wilson Coldham:

          Reasons for Transportation: Convict, sentenced to transport.

     Another John Blackstone also sailed on the “Honor” from London, England setting sail on May 1720 and arriving January 1721 in York River (Yorktown). Arrival was confirmed. He was a convict sentenced to transport. It appears that this John was too old to have been the John Blackstone who settled in Pitt County, North Carolina around 1769. Yet another John Blackstone sailed on the “Tryal” from London, England setting sail on April 1750 and arriving June 1750 in Maryland. Arrival was confirmed. He was a convict sentenced to transport. From a review of census and deed records, it appears that this John remained in Maryland. At this point in time, it is impossible to determine whether any of these John Blackstons were in fact the John Blackston that settled in Pitt County, North Carolina around 1769.

     The practice of transporting convicts, who would otherwise have been executed, dates back to at least 1597. By 1660, transportation was an accepted form of punishment following a royal pardon. An Act of 1718 established transportation to English colonies in America as the standard sentence for many less serious offences. One of the most common crimes for which people were transported was theft. Transportation to America ceased in 1775. Transportation was for a period of years, usually seven or fourteen years and occasionally even life. After conviction, felons remained in prison until their transportation. Convicts to be transported were handed over to agents who could dispose of their services to local landowners. Shipmasters certified receipt of the convicts and obtained landing certificates on arrival in America from the governor or chief customs house officer. These landing certificates were returned to the courts as evidence that the sentence had been carried out. By 1718, most convicts were taken to Maryland or Virginia and this continued until 1775. The cost of transportation was borne by the state. Contractors were appointed to provide ships and transportees' services were sold on arrival. The contractor gave a bond to guarantee that transportation would take place and that the convict would not return until the end of his or her sentence.

The Grant was witnessed by Tho. Braxton and Paul Scale. The Land Grant is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book No. 29, page 253 as Grant Number 3 issued on July 1, 1779. Again, since family members often witnessed the deeds for relatives, Tho and John were most likely closely related.

As recorded in this Land Grant, John Braxton paid 50 Shillings for this 250 acres tract of land described as being "...on the South side of The Tarr River and West Prong of Swifts Creek...to a gum in the reedy branch..." The Grant was witnessed by James Braxton and James Braxton Jr. The land was adjoining John Simpson and William Joiner's land. The Land Grant is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book G, page 183. James may have been John's father and the grandfather of James Braxton Jr.

Deed*John sold property at Swift Creek, Pitt County, North Carolina, on 04/17/1787. James Handcock paid him 50 pounds for this tract of land. It was described as containing 100 acres, more or less, and being on the "West Side of the West Prong of Swift Creek" and being a part of a 200 acres land grant John received on May 5, 1778. Dennis Cannon and Solomon Sutton were witnesses to this deed. This deed is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book M, Page 18-19.

Census 1790*John was listed as the head of a family on the 1790 Federal Population Census at Pitt County, North Carolina. John's last name was spelled Blackston. The following entry was made of his household: Free White Males 16 years of age or older, 4; Free White Males less 16 years of age, 0; Free White Females, 3; all other persons, 0; Slaves, 0. From this record we know that he most likely had at least three sons 16 years of age or older and two daughters. From deed records we know that he had at least one other son, James, who was born ca 1750 and who now had his own home. His entry is recorded on page 458 of the 1790 Pitt County North Carolina Federal Population Census.

     A detail review of the 1790 census shows that Thomas Blackston lived beside of John and on the other side of Thomas lived James Blackston. Most likely, the three of them were related. Their entries in the Census follow:

On the same page of the census there are two other Braxton families recorded some twenty-four households away and their entries follow.

Deed*John and his son James Braxton sold property at Pitt County, North Carolina, on 03/08/1793. James Ringgold paid John and James Braxton 75 pounds for this tract of land. It was described as containing 50 acres, more or less, and being on the "Horse Pin Branch". This would appear to be part of John Braxton's 1773 land grant for 180 acres. This deed was witnessed by John Fulford and Hardee Handcock. This deed is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book M, Page 691.

Caleb Tripp Senior paid John and his wife Mary Braxton 45 pounds 10 Shillings for these 100 acres located on a branch of the West Prong of Swift Creek and bounded by Reedy Branch and Gum Swamp. In this deed, Mary was identified as "Mary Braxton the wife of John Braxton Sen". This deed was witnessed by Shadrock Moore, John Fulford, and Wm. Whitfield. This deed is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book N, Page 456-457. This record offers further proof that John's wife was named Mary. Another interesting aspect of this deed is that Caleb Tripp Senior was the Grandfather of Cennetta Tripp who in 1877 married John's great grandson Warren Braxton.

It is believed that William Braxton was a son of John Braxton 1st.

After John's death, this tract of land, containing 60 acres more or less, was sold to Charles Jenkins at public auction for 10 pounds. One unusual aspect of this transaction is Charles Jenkins was the person who had petitioned the court to sale John's land in order to repay a 24 pound 6 shillings loan Charles had made to John. The deed is recorded at the Pitt County Courthouse in Greenville, North Carolina Deed Book AA, Page 26-27. Deed was witnessed by Sampson and Samuel Powell.

Biography* In the 1790 Census, John's name is recorded as John Brackston Sr. In a review of deeds from the late 1700s and early 1800s, his name was most often spelled John Braxton. He may have come to America in 1750 from England. A John Blackston arrived in York River, Yorktown, Virginia from Middlesex, England in 1750. It might also be possible that John was the son of James Blackston an early landowner in Pitt County, which was formed from Beaufort County on January 1, 1761. In the following year, the earliest record of the Braxton Family appears in the List of Taxables, Pitt County, North Carolina. In 1762, a James Blackston is listed as a landowner. In the 1763 List of Taxables, Pitt County, a James Blaxton appears. Most likely, these two James were the same individual.

The deed is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book H6, Page 224 and reads as follows:

"WITNESSETH: That said Franklin McLawhorn and Mary his wife, in consideration of three hundred dollars to them paid by the said John W. Braxton, the receipt of which is hereby acknowledged, ha..... bargained and sold, and by these presents do..... bargain and sell and convey to said John W. Braxton and his heirs, a certain tract of land in said County and State, North Carolina adjoining lands Biggs Harrington, Irwin McLawhorn & wife & others termed as follows any, on the south side of the Tar River in Contentnea Township, Begining at a stake in Tuskins Meadows thence up a drain to a light wood stump in said drain to as near a turn in said drain thence up said drain to a gum in said Franklin McLawhorn old line near the head of the said drain thence with the said Franklin McLawhorn line to Irwin McLawhorn and wife line, to a stake thence unto said Irwin McLawhorn and wife line to Joseph McLawhorn and wife line thence to Biggs Harrington line to a stake in Tuskins Meadows thence down a ditch to the beginning containing 25 acres more or less."15

Living on the farm beside of John was his brother Christopher Columbus Braxton Jr. and his wife Alice. Skilton Dennis lived 11 farms away from John's.

The following individuals in his household: Sarah Braxton, John's wife, age 37,she had 8 children and 8 were alive; Thadus, son, age 16; Heber, son, age 13; Nellie, daughter, age 10; Eva, daughter, age 6; David, son, age 4; Leon, son, age 2. Deed*John Warren Braxton bought property at Winterville Township, Pitt County, North Carolina, on 12/07/1920. He purchased 122 1/2 acres from the estate of EF Cox. He later left this land to his wife as a part of his estate. The deed is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Books: L13, Page 92; J13, Page 389.20

 
Census 1930* On 04/03/1930, John was listed as the head of a family on the 1930 Census at Ayden Township, Pitt County, North Carolina. John Warren Braxton 60/M.21 
Will*John's will was written and signed by him on 01/15/1932. The Will was not recorded at the courthouse until April 17, 1934, six days after he died. His wife Sarah had the Will recorded and the two witnesses, G.W. Prescott and L.B. Kinlaw, swore that they had witnessed John's signature of the hand written Will and that he had attested to them that this was his Last Will and Testament and that he was of sound mind. The Will is recorded in Book 6, Page 375 at the Pitt County Courthouse in Greenville, North Carolina. His Will reads as follows:

" I, John W Braxton, of aforesaid County and Sate being of sound mind, but considering the uncertainty of my earthly existence, do make and declare this Last Will and Testament.

FIRST: My Executrix hereinafter named, shall give my body a decent burial suitable to her wishes, and pay all funeral expenses, together with all my just debts, out of the first moneys which may come into her hands, belonging to my estate.

SECOND: I give and bequest, and devise unto my wife, Sarah Marina Braxton all of my real estate of every description located and situated in Pitt County, to have and to hold in Fee simple absolute, including and being (1) The home place on which I now live and reside in Ayden Township, it containing 25 acres more or less the same being registered in Book of Deeds H-6, at page 224, of Pitt County, and purchased in 1895, And (2) That certain tract of land which I now own in Grifton Township, Pitt County containing 122 1/2 acres more or less, it being the lands purchased from E F Cox, as shown by Books of Deeds in Pitt County, together with any and all other lands which I now have or may be entitles to, in fee simple absolute.

THIRD: I give and bequeath unto my wife Sarah Marina Braxton all my personal estate of every description and whatever kind, and wheresoever it may be located and found, which includes any insurance which may be due my estate from the Standard or Jefferson Standard Life Insurance Company, except it is my desire and wish that my executrix pay to each of my children $5.00 each.

FOURTH: I hereby appoint my beloved and trusted wife without bond my executrix to all intents and purposes, to execute this my Last Will and Testament, according to the true intent and meaning of the same, and every part and clause thereof, hereby revoking and declaring utterly void all other Wills and Testaments heretofore made by me.

Sarah's middle name was spelled Marina. In all other records, the spelling was Marena.

Biography* John and his sister, Lovie Louvenia Braxton, married brothers and sisters; Jack McLawhorn and Sarah Marena McLawhorn. According to Harvey Everett, his wife Selma, daughter of John and Sarah, told him that in the early 1900s John owned the sawmill once owned by his father Christopher Columbus Braxton. It was set-up about 50 feet off what is now known as Jolly road near the second street intersection on the land where the Ayden Elementary school is located today. He utilized this sawmill to cut the lumber he used to build his family home know today as the "Old Home Place."

     This story demonstrates it was a small world back in the early 1900's in the Winterville and Ayden area. John Robert Pilgreen told his daughter, Edna, that during prohibition, he bought moonshine from John and Sarah Braxton who were the grand parents of her future husband, Heber Guy Braxton. When he went to their home, John and Sarah's youngest sons, Leon and Harvey, would dive down in the pile of hay in the barn until one of them found a pint of moonshine. Edna's father, John, would pay Sarah for it and then be on his way. It would appear that tobacco and cotton were not the only cash crops that John and Sarah had.

     During an October 27, 2001 interview with Kenny and Guy Braxton, Harvey Everett told a very similar story. He said John, his father-in-law, had a vine that grew up and pretty much covered the right end of his front porch. The drive coming up to his home was relatively straight and about a 1/4 mile long. He could sit behind the vine without being seen and watch for people coming down the drive to his house. He kept moonshine in the space above the front porch and he could slide a section back to get at the moonshine. When he saw someone coming down the drive, he would close this section of the ceiling. To quote Harvey, "John was a retailer." He did not own a still. As Harvey tells it, for many years, Joe McLawhorn was the Pitt County Sheriff. He often stopped by and had a drink with John. It was not unusual for him to spend half the day drinking and talking with John and typically, he bought a pint before he left. According to Harvey, like many of his contemporaries, John dipped snuff.

     John was a very successful farmer and entrepreneur. He owned approximately 160 acres of land that he and his family farmed. According to both Harvey Everett, John's son-in-law, and Heber Guy Braxton, John's grandson, during the 1920s John had a carbolic electrical system installed in the "Old Home Place." On more than one occasion, he lent money to others. In one such instance, he lent Jasper N Moore $500 for a year. From the pictorial record that exists, he and his wife had family portraits made every few years. He had life insurance and a Will when he died.
