There is a cemetery on the property that James Thomas and Sarah Ann sold to Mr. Hays; it is referred to as the Hays Cemetery...a search of this cemetery by others did not find a grave for Felix W, who, according to family legend, is buried here

Civil War*James enlisted into the Confederate Army at West Bay, Florida, on 02/19/1862. In the 1980s, Jean Casper wrote to the National Archives for the records of James Thomas Braxton. What she received was a mix of documents for James T. Braxton and J. A. Baxter. The James T. Braxton records are all signed by the same person, L. Ballard and the J. A. Baxter records are signed by several different people. There are 4 records for James T. Braxton, all relate to service in Co. A, 11 Florida Infantry. The final record is for November and December 1864 and gives the following details:
     Enlisted: April 15, 1863
     Where: St. Andrews
     By Whom: Captain Robinson
     Period: War
     Last paid by: Captain Wood
     Time: April 30, 1964
     Present or Absent: absent
     Remarks: Captured and in hands of enemy since September 10, 1864

The 11th Infantry Regiment was organized in June, 1864, by consolidating part of the 2nd and the 4th Florida Infantry Battalions. Many of the men were recruited in Hendry, Jackson, and Bradford counties. Placed in General Finegan's Brigade, Army of Northern Virginia, it was active at Cold Harbor, then saw action in the Petersburg siege south of the James River and the Appomattox Campaign. In April, 1865, it surrendered 4 officers and 19 men. The field officers were Colonel Theodore W. Brevard, Lieutenant Colonel James F. McClellan, and Major John H. Gee.

Marriage*He married Wife of Jesse Braxton c __/__/1785. From a review of the 1800, 1810, and 1820 Census records, it would appear that Jesse and his wife had at least 12 children including Joel Braxton.. 
Death*Jesse died c __/__/1825. Jesse is in the 1820 Pitt County, North Carolina Federal Population Census and he cannot be found in the 1830 Census. Most likely, he died about 1825.

Deed*Jesse bought property at Swift Creek, Pitt County, North Carolina, on 02/03/1797. John Braxton sold 100 acres, more or less, for 20 pounds to Jepse Braxton. In this deed, the land is described as lying on the "South Side of the West Prong of Swift Creek" and this is part of a 200 acres land grant John Braxton received on May 4, 1778. The land at that time was described as being "on South Side of the West Prong of Swift Creek". The deed is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book N, Page 359. It is believed that Jepse Braxton was a son of John Braxton 1st.

Joel Braxton most likely is one of the two boys age 17-26. Joel would have been age 17-20 in 1810. Jesse's entry is recorded on Page 237 of the 1810 Pitt County, North Carolina Federal Population Census.

     From this entry, we know that most likely Jesse and his wife now have eleven children, four boys and seven girls. It also appears that they no longer owned slaves.

Census 1820*Jesse was listed as the head of a family on the 1820 Census at Pitt County, North Carolina. Jesse's name is spelled Jessa Brakson in this Census record. The following entry was made for Jesse's household: Free White Males: age 16-18, 1; age 19-26, 1; age 27-45, 1; over 45, 1; Free White Females: under 10, 2; age 10-16, 2; age 19-26, 3; age 27-45 1; Foreigners not naturalized, 3. His entry is recorded on Page 551 of the Pitt County 1820 Federal Population Census. It would appear from this record that Jesse's wife has died. She was listed in the 1800 census as age 27-45 and again in the 1810 Census as age 27-45. Therefore, by 1820, she would have had to been 47-55 years of age. This record indicates that three members of Jesse's household were not born in the United States. The question is which three. Jesse's father, John Braxton 1st, has been in the United States since at least the time of his first recorded deed, 1768. From a review of Census records, we know that the earliest Jesse could have been born is 1765. If he was not born in the United States, his family moved here when he was age 2 to 3.

Deed*Jesse had property sold at public auction at Swift Creek, Pitt County, North Carolina, on 02/20/1822. The court ordered that the 100 acres he purchased from John Braxton in 1797 be sold at the Court House door to repay a $140.72 debt to the Bank of New Bern that was past due. It appears from the deed that Jesse and a Charles Jenkins borrowed the money. James Powell paid $60 for the land. This deed is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book BB, Page 455. It is recorded in this deed that Jesse was living on the land at the time of this foreclosure. From a review of deeds, we know this was the only land Jesse ever owned. This very well may explain why there is no record of Jesse's son Joel, inheriting any land from his family and supports the hypothesis that Joel was a son of Jesse.

Biography* Several spellings of Jesse's name can be found in the records. In the 1800 Census, his first name is spelled Jepse and in the 1810 Census, it is spelled Jesse. In a review of land deeds, I have found his first name spelled as Jepe, Jepse, and Jesse all within the same record.

     In the 1800 and 1810 Census, his last name is spelled Blackston. In the 1820 Census, it is spelled Brakson. During the same time period, his last name is spelled Braxton in several deeds.

     A review of deeds reveals that Jesse bought property from John Braxton Senior in 1797 at below market value. It is a well-documented fact that during this time period fathers quite often sold land to their sons at below market value and based upon this information it appears Jesse was one of John's sons.

     From a close analysis of the 1800 and 1810 Census, if we assume Joel Braxton's father is recorded in the Pitt County Federal Population Census, his father had to be Jesse Braxton. Jesse is the only Braxton, Blackston, or Brackston in the 1810 Census who had a son the age of Joel who at that time would have been 17, which further supports the hypothesis that Joel was a son of Jesse.

Census 1830*Joel was listed as the head of a family in the 1830 Federal Population Census at Capt Saml Smiths District, Pitt County, North Carolina. Joel's household included the following individuals and age ranges:
     * Under 5: 2 males, 1 female
     * 5 to 10: 0 males, 1 female
     * 10 to 15: 1 male, 1 female
     * 15 to 20: 0 males, 1 female
     * 30 to 40: 1 male, 1 female.
The one thing clear from this census record is Joel and his wife Sallie are the two individuals age 30 to 40. Most likely, the male listed as 10 to 15 years of age is Phelix and Warren and James are the two boys under 5. Most likely, the female 15 to 20 years of age is Susan, the female 10 to 15 years of age is Martha, the female 5 to 10 years of age is Elizabeth and the female under 5 is Mary. In the 1860 Federal Population Census, Warren Braxton's age is recorded as 40 and in 1877, when he married Cennetta Tripp; his age was recorded as 56. This would indicate he was born about 1822. If you add ten years to each persons age recorded in this 1830 Census, in the 1840 census Joel's household, should have two males 10-15 and one male 20-30, plus Joel 40-50. What is actually recorded is one male 10-15, one male 15-20, one male 20-30 and one male 40-50. The male 15-20 should have been listed in the 1830 census as 5-10 and is most likely Warren. This would be compatible with Warren being born in 1820. The male 20-30 is Phelix and of course, the male 40-50 is Joel. Base upon this interpretation, Warren had one younger brother; one older brother, Phelix; one younger sister; one sister approximately his age; and two older sisters. It is also recorded in this 1830 Census that Joel owned one slave. Joel's entry is on page 56 of the 1830 Pitt County, North Carolina Federal Population Census.

The following families lived on farms either near or adjacent to Joel's farm.
1). Jesse Braxton lived five farms from Joel's farm and beside of Himerick Braxton. From a review of other census records, I believe Jepse was Jessie Braxton and father of Joel. Jepse's household included the following individuals and age ranges:
     * Under 5: 0 males, 0 females
     * 5 to 10: 0 males, 1 female
     * 10 to 15: 0 males, 1 female
     * 15 to 20: 0 males, 3 females
     * 20 to 30: 0 males, 2 females
     * 30 to 40: 1 male, 0 females
     * 50 to 60: 1 male, 1 female
Jepse and his wife were the two individuals age 50 to 60.

John must have been the individual age 40 to 50. At this time, we cannot determine who the female age 50 to 60 is.

6). Council Braxton lived on a farm on one side of Joel's farm and his household included the following individuals and age ranges:

     * 5 to 10: 0 males, 0 females
     * 10 to 15: 0 males, 0 females
     * 15 to 20; 1 male, 0 females
     * 20 to 30: 1 male, 0 females
     * 30 to 40: 1 male, 1 female
Council and his wife must have been the individuals age 30 to 40.
     From the Record of Estates 1858-1871, Part 2, Page 703-705 for the estate sale of Council Braxton, we have learned that Joel's sons, Felix and Warren, were listed on August 6th 1861 as owing Council Braxton $166.50 that they borrowed on February 10th 1860. This perhaps indicates a close relationship.

Deed*Joel bought property at Cypress Branch, Pitt County, North Carolina, on 12/16/1835. The land was located near Cypress Branch. This is the only record of Joel buying land in Pitt County, North Carolina. He purchased one hundred and one-half acres for three hundred dollars from Barrum Hart. This deed is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book LL, Page 278.

"This indenture made and entered into this the 16 day of December eighteen hundred thirty-five witnef Barrum Harte of the county of Pitt state of North Carolina of the one parte and Joel Braxton of the said State & County of the other parte witnesseth that a Barrum Harte and for and in consideration of the sum of three hundred dollars to me in hand paid by Joel Braxton before the signing and sealing of these present the receipt whereof I do hereby acknowledge myself fully satisfied and thereunto contented have bargaining sold enfeoffe and conveyed and confirmed and by these present do bargain sale and confirm and convey unto the Said Joel Braxton a certain track or parcel of land lying on the West Side of Swifts Creek Bounded as follows beginning at a stake in the cypress branch thence with Joshua Nobles line north 19 west 270 poles along a line of marked trees to a small pine (in the center of one pine and three black jack oaks) now Jonathan Kittrells corner thence with his line South 83 West 25 poles to a frost oak then south 12 east 17 poles to a pine thence south 55 west 120 poles to a dead pine Author McGlowhorn corner thence with his line south to Johnson Nobles in the Cypress Branch thence with the Cypress Branch to the beginning. Containing one hundred & one half acres be the same more or less to have and to hold the said land and premises with all and Singuly affecting or in any wise there unto belonging unto him the said Joel Braxton his heirs and afsign forever and I the said Barrum Harte for myself my heirs or assigns doth warrant and forever defend the title of the said land unto the aforesaid Joel Braxton to him and his heirs executors and administrators and assigns against the lawful claim or claims of all person or persons whatsoever. In witnef whereof I the said Barrum Harte have hereunto set my hand and seal the day and year first above writtened signed sealed and delivered.

     In an effort to determine the location of Joel's land, We have researched this acreage back to the original 1790 Land Grant received by Thomas Cannon Senior. The history of the ownership of this land follows. As recorded in this deed, Joel bought the farm in 1835 from Barrum Hart. Barrum acquired the land from Moses Slaughter on September 28, 1829 for three hundred dollars and this deed is recorded at the Pitt County Courthouse in Book DD, Page 452. The land is described as follows:

"certain track or parcel of land lying on the West Side of Swift Creek Bounded as follows, Beginning at a stake in the cypress branch and running with Joshua Nobles line which is north thirteen west two hundred and seventy poles along a line of marked trees to a Small pine in the centre of one pine and three black Jack oaks said (Charles) Jenkinses thence his line south eighty three west twenty five poles to a frost oak then south twelve east seventeen poles to a pine thence south fifty west one hundred and twenty poles to a dead pine Adam McGlowhorn corner thence with his line south to John Moores in the Cypress Branch thence with the Cypress Branch to the beginning. Containing one hundred and one half acres be the same more or less the above bounded being apart of two parcels both granted to Thomas Cannon the oldest for two hundred acres, the youngest one for fifty three acres."

     From this deed, we know that this tract of land was a part of Thomas Cannon's Land Grants from the state of North Carolina. A further review of land deeds tells us that Moses Slaughter originally acquired this land on May 9, 1826 from Matthew Slaughter for three hundred dollars. This deed, basically, reads the same as the above deed to Barrum Hart and is recorded in the Pitt County Courthouse, Greenville, North Carolina in Deed Book DD, Page 341. Matthew Slaughter acquired the land from Henry Cannon, son of Thomas Cannon, on October 10, 1817 for three hundred dollars. The deed, basically, reads the same as the above deed to Barrum Hart, except it describes the tract as one hundred and twenty eight acres more or less and it identifies Henry Cannon as the son of Thomas Cannon. The deed is recorded at the Pitt County Courthouse, Greenville, North Carolina in Deed Book AA, Page 18. Thomas Cannon was granted one of two parcels that comprised this land by the State of North Carolina on November 17, 1790. The land was surveyed on March 26, 1788. He paid one hundred shillings for the two hundred acre tract of land. The deed was recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book K, Page 260. One of the interesting parts of the deed is it identifies the Governor as, "Governor, Captain-General, and Commander-in-Chief at Fayetteville." It also records the date as "November 17 in the fifteen year of our independence".

     Another interesting fact relative to the various owners of this land is that Thomas Cannon's great granddaughter, Sarah Cox Braxton, would later marry Joel's son, Warren Braxton, and in 1845 they would acquire one-half of this one hundred and one-half acre tract from Warren's brother, Phelix. I wonder if they knew in 1845 that this tract of land was originally owned by Sarah's great grandfather.

Deed*Joel gave this property to his son Phelix at Pitt County, North Carolina, on 02/29/1836. This deed is recorded at the Pitt County Courthouse in Greenville, North Carolina in Deed Book LL, Page 510. Thus far, no other deeds have been found in which Joel is recorded as buying land. It is unclear why Joel deeded what appeared to be his entire estate to his son. From this record, it appears that perhaps Joel's health had failed and Phelix was going to look after Joel and his wife Sallie. However, fours years later, in the 1840 Federal Population Census, Joel is recorded as the head of a household that appears to include his wife Sallie, Phelix and his wife Sarah, Warren, and one other son and five daughters. Joel's name is spelled once in this deed as Jolly and twice as Joel. The deed is recorded as follows:

"Knows all men by these present that to whome it may come Greetings how it that I Jolly Braxton do for the consideration of the natural affection which I have and bears towards my son Felix Braxton have given into his on certain tract or a parcel of Land lying in the county of Pitt adjoining Joshua Nobles, Jonathan Kittrell line, Arthur McGlowhorn, containing one hundred
acres to the same more or less also all my stock of all kind cattle sheep Hogs Household furniture cart gear etc. To have and to hold the aforesaid property unto him the said Felix Braxton him his Heirs Encestors aliving as of signing forever and I the said Joel Braxton do warrant and defend the Rite and title of the above said property from the claims or claiming of all persons or person claiming by through or under me in witness where of I have hereunto set my hand & seal this 29th February 1836."

We know from other records that Arthur McGlowhorn's great granddaughter Sarah Marena will marry Joel's great grandson John Warren some 54 years later in 1890.

Census 1840*Joel was listed as the head of a family on the 1840 Census at Pitt County, North Carolina. Joel's household included 19 people counting 8 slaves:
     * Under 5: 0 males, 1 female
     * 5 to 10: 0 males, 1 female
     * 10 to 15: 1 male, 2 females
     * 15 to 20: 1 male, 1 female
     * 20 to 30: 1 male, 1 female
     * 30 to 40: 0 males, 0 females
     * 40 to 50: 1 male, 1 female
It would appear that Warren is the boy age 15 to 20 and Phelix is age 20 to 30 and that Phelix' wife, Sarah, is the female age 20 to 30. The two people age 40 to 50 are Joel and his wife Sallie. It also appears that Warren now has one younger brother, James; one older brother, Phelix; two younger sisters; two sisters approximately his age and one older sister. Combining the information in this census with the 1820 Census, and the 1830 Census it appears that Warren had two younger sisters, two sisters about his age, three older sisters, one younger brother, and one older brother. Therefore, Joel and Sallie had at least ten children.

     I also discovered something surprising from the 1840 Census Slave Schedule. Joel owned eight slaves: there were two females under 10, two females age 10 to 24, and two males and two females age 24 to 36. His record reads:
     * Under 10: 0 males, 2 females
     * 10 to 24: 0 males, 2 females
     * 24 to 36: 2 males, 2 females
All of Joel's household were farmers and no one had ever attended school or could read or write.

Biography* The following narrative is my interpretation of the information we know about Joel and Sallie's family.

     I believe that the Phelix born circa 1815, and who married Sarah Ann Sutton, was Joel's son, not the Phelix who married Mahalia Smith. Many other researchers have come to the opposite conclusion.

     Joel bought property in Pitt County, North Carolina, on December 16, 1835. The land was located near Cypress Branch. This is the only record of Joel buying land in Pitt County. He purchased one hundred and one-half acres for three hundred dollars. The deed is recorded at the Pitt County Courthouse in Greenville, North Carolina in Book LL, Page 278. This land is located at GPS Coordinates: N35° 29.316 W077° 24.979.

     The following year, 1836, he gave this land to his son, Phelix, and the deed is recorded in Deed Book LL, Page 510. Since it is stated in the deed that Phelix was his son, we know for a fact Joel had a son named Phelix. At the time of this deed, Phelix would have been at least 21.

     On January 30, 1845, Phelix sold half, 50 Acres, of this land to Warren Braxton. The deed is recorded in Deed Book LL on Page 292. Since Warren listed Joel and Sallie Braxton as his parents on his Marriage Register to Cennetta Tripp on August 16, 1877, we know with certainty that Warren was the son of Joel and Sallie. Therefore, we know Phelix and Warren were brothers. We also can assume from this record that Warren must have been at least 21 in January 1845 and from this we know he was born before 1824.

     We also know from Phelix's 1886 will that he had a brother named James. From the information thus far summarized, we know that the three Braxton boys recorded as members of Joel's household in the 1840 census were, Warren, Phelix, and James.

     James wrote several letters to Caleb Smith of Pitt County, North Carolina from Florida starting in 1854 and ending in 1861. From the letters, we learn that Caleb was the husband of James' sister Elizabeth. In the letters, James writes that his brothers were Warren and Phelix and that he had another sister named Mary. The letters reinforce the interpretation that Joel and Sallie's children included Warren, Joel, Phelix, Elizabeth and Mary.

     Another factor that supports the conclusion that Phelix, who married Sarah Ann Sutton, is the brother of Warren and the son of Joel is an interesting recording in both this Phelix's and Warren's households in the 1850 Census. If we back up to the 1840 census, in Joel's household there was one female under 5 and one age 5 to 10. We believe Joel died around 1845. In the 1850 census there is a Mary Braxton age 18 in Phelix and Sarah's household who is too old to have been their child but she could have been the female 5 to 10 in Joel's household in 1840. Also in the 1850 census, there is a Martha Braxton age 15 living in Warren's and Sarah's household who is too old to have been their daughter but she could have been the female under 5 in Joel's household in 1840. It is possible that both Phelix and Warren had taken in one of their younger siblings after their parent's death.

     Throughout the numerous documents that we have reviewed, Warren and Phelix (Felix) are often linked. In several deeds, Phelix (Felix) was a witnessed for Warren. I have also discovered in the Record of Estates 1858-1871, Part 2, Page 703-705 for the estate sale of Council Braxton, that Felix and Warren were listed on August 6th 1861 as owing Council Braxton $166.50 that they borrowed on February 10th 1860. One additional interesting point can be found in the 1830 Census. Council Braxton lived on the farm beside of Joel's farm and was the approximate age of Joel 30-40. From the 1850 and 1860 Census, we know he was born in 1800. We also know from the 1850 Census that Council lived 10 farms from Phelix (Felix) married to Sarah. Council may have been Joel's brother.

     The final reason I believe the Phelix that married Sarah is the son of Joel, is his wife Sarah, is buried in the Ben Byrd/Cox Family Cemetery in a small section that contains just Braxton's. She is buried bedside of Warren's son and daughter-in-law, Christopher and Sarah Braxton. The inscription on her tombstone is "Sarah A. wife of Phelix Braxton, December 25, 1825 - September 26, 1909." Warren's great grandson, Christopher junior, and Warren's great granddaughter Sarah Marena Braxton McLawhorn, are also buried there. If Sarah A. Braxton is not closely related to Warren or Joel, she is the only Braxton buried in this cemetery that was not a part of this Braxton Family. Also buried near Phelix's wife Sarah is Sarah Evans who at age 22 was recorded as living in Phelix's and Sarah's household in the 1880 Census and who is reported to be Sarah's niece.

     Family stories tell us that Warren is also buried in this cemetery in an unmarked grave. However, we are not totally convinced this is true. At the time of his death, Warren and several of his children were wealthy enough that the purchase of a grave marker would not have created a hardship. In his latter years, he gave over three hundred acres of land to four of his sons, Christopher, David, Henry and Felix and he still owned or controlled through a life estate more than 400 acres at his death.2,8,3,4,10
