Whereas Hardy Tripp personally appeared before me W L Cherry one of the acting Justices of said county and maketh oath the he believes Augustus Braxton did on the 2nd day of November 1866 Waylay and shoot him with the intention to kil; He also believes he (Trip) is in danger of his lif by said Braxton, He also believes Braxton will damage his private property. These are to command you to take the body of Agustus Braxton if to be found in this county and bring him before me or some other Justice of Pease to answear Said Complaint Hearein fail not Given under my hand and Seal this November 15th 1866. WL Cherry JP summon for Plaintiff Aurena Fulford, John Tripp, Bryant A. Tripp, Jere Weatherington, W.F. Harrington, Laurence Tripp, C.F. Harris, Summon for Defendant Shem Tyson, Ferdina Anderson, George Moye, Richard Moye" A second hearing was held 15 days letter and the following is a transcript: "State vs. Augustus Braxton, Indct Assualt with intent to murder. On November 27th 1866 this order was executed by Jos H. Gray Shf, Powell W. Moore DS. Witnesses: Aurena Fulford, John Tripp, Bryant A. Tripp, WF Harrington, Laurence Tripp, Hardy Tripp, Jere Wetherington. Not a true Bill: Wm. G. Little Foreman" A third hearing was on December 8 and the following is a transcript: "The within warrant for Trail to me this day and the Plaintiff not being present or any witnesses appearing the Trail is postponed until Saturday the 15th December 1866. Dec 8, 1866 Edwd Hoell J.P." A fourth hearing was held on December 17th and the following is a transcript: "The above warrant is further postponed until Monday 17th 1866 at 12 oClock am Dec 17, 1866. Edwd Hoell J.P. " A fifth hearing was held on December 17th and the following is a transcript: "Jermiah Worthington after being duly Sworn Says about 12 months ago Augustus Braxton was at his home & took from his (Braxton's) Pocket a Pistol & remarked if I had this Pistol I would have Killed Hardy Tripp when I had a fight with him & I inted to Shoot Tripp yet I can see him at Old Pattie Moore's any time & I will give it to him there. This evidence was objected to by the Defendant Braxton & overuled by the Justice of the Peace Edward Howell. E Howell J.P. Jeremiah (his mark) Worthington" "Aurena Fulford being duly Sworn Says SHe heard Augustus Braxton Say the first of the year of the war the he intended to Shoot Hardy Tripp. This evidence was objected to by the Defendant Braxton & overruled by the Justice of the Peace Edward Howell. Edward Hoell JP Aurina (her mark) Fulford Decr. 17 1866" "Parties appeared before me this day the evidence being sufficient I therefore bind the defendant in a Bond of $500 for his appearance at next March Court 1867. Decr. 17, 1866 Eded Hoell J.P. " The sixth, and perhaps final hearing, was held in the Spring of 1867 and the following is a transcript: "State of North Carolina Pitt County Superior Court of Law Spring Term 1867 The jurors for the state upon their oath present that Augustus Braxton late of the County of Pitt on the 1st day of January in the year of our lord one thousand eight hundred and sixty seven with force and arms at and in the County aforesaid with a Certain Pistol, charged with powder and ball, which the said Augustus Braxton in his right hand then and there had and held in and upon Hardy Tripp in the peace of God and the state then and there begindid make an assualt with intent to kill the said Hardy Tripp then and there feloniously wilfully and of his malice aforethough to kill and murder, and other wrongs to the said Hardy Tripp then and there did against the peace and dignity of the state. And the jurors aforesaid upon their oath aforesaid do further present that Augustus Braxton, with force and arms at and in the County of Pitt on the day & year aforesaid in and upon the body of one Hardy Tripp in peace of God and the state then and there breing, an assualt did make, and the said Hardy Tripp then and there did beat wound and ill treat Contrary to law and against the peace and dignity of the state. | Milit-Beg* | Guy was inducted in to the US Navy at Raleigh, Wake County, North Carolina, on 02/18/1948. He actually joined the Navy in Greenville at the recruiting office. On this day, in Raleigh, he was given a physical and sworn into the Navy. He was then put on train to Great Lakes, Illinois for three months of boot camp. His first tour of duty was in Pensacola, Florida at an airplane overhaul facility. His next tour of duty was in Corpus Christi, Texas at the Advance Aviator Training Facility. Here he worked on the flight line and then transferred to the Flight Training Office in aircraft scheduling. His three-year enlistment was up in February 1951. However, because of the Korean War outbreak, Truman had frozen all enlistment. After reflection, Guy decided to go ahead and re-enlist. He was then transferred to Fighter Squadron 193 aboard the USS Princeton, CV37, which was a part of the US Seventh Fleet assigned to the Korean Campaign for the next 11 months. It had 4 Squadrons of 20 aircraft each and 5000 crewmembers. Among the aircraft aboard ship were the AD1 that had a 3360 reciprocating engine and were decked launched with a payload of 10,000 pounds. After this tour of duty was completed, he came back to the states and stayed about 8 months at Moffitt Field outside San Francisco. Then his Squadron was transferred aboard the USS Oriskany, CV34, for duty again in the Korea Campaign. About the time the Oriskany arrived, the truce was signed. He received orders to transfer to Kingsville, Texas. He took an ammunition ship from Japan, the first of December 1953, to San Francisco arriving 18 days later. Wanting to arrive home before Christmas, Guy hitched hiked home in three days to Ayden, North Carolina arriving Christmas Eve and days ahead of the bus. He visited for approximately 30 days and then he and family moved to Texas in January 1954. Here Guy worked on test flights as an aircraft mechanic. He was transferred in the fall of 1957 to the Radar Early Warning Squadron (VW1) in Guam where he and his family lived for the next two years. Before leaving for Guam, he had two months of crew chief training in Burbank, California. In Guam, he flew as crew chief aboard WV2, the radar version of the Super Constellation, flying electronic surveillance over the US Seventh Fleet. Guy was transferred from Guam in January 1960 to the Advanced Aviation Machinist Mate School for six months in Millington, Tennessee. Next, he was transferred to Pawtuxet River, Maryland to the Radar Early Warning Squadron (VW13) for six months and then six months later transferred to VR1 Fleet Tactical Support Squadron 1 (VR1) transporting cargo and personnel wherever needed. In 1965, he was transferred to Quonset Point, Rhode Island to VS32, an aircraft antisubmarine squadron. Next, he was transferred to Mayport Naval Station in Florida aboard the USS Saratoga, CVA62. Here he was responsible for the ship's aircraft, Carrier Onboard Delivery (COD), and spent six months in the Mediterranean Sea. In 1967, he was transferred to Norfolk, Virginia to the Naval Air Rework Facility, NARF. Here he woukd finish his naval career. He was first assigned to the test flight division and later Guy was transferred to VRC40, which flew mail and cargo to the fleet. In June 3, 1974, he transferred to the Fleet Reserves for the next three years and then he retired with 30 years of service on June 3, 1977. .5 |
| Biography* | Guy's parents were life-long framers and he grew up on a farm. One day, when Guy was young and his family was in the field, he had to run to the house and his sister, Inez, asked him to bring her a collard biscuit back. He prepared two; one with a frog and one without a frog! Yes, he put a frog in his sister's biscuit scarring the dickens out of her. She chased and chased him around the field but she could not catch him. A friend of Guy's, Donald McLawhorn, sister got a small horse in 1946 for Christmas, and he was too wild for her to ride it. Guy brought the horse home to ride and train for her. In hindsight, perhaps he should have asked his parents first! Although they were not happy about it, they did not make him take the horse back. While riding the horse bareback down Jolly road, something scared the horse, and it took off running with Guy hanging on. The horse ran under a clothesline and Guy had to lie down to clear it. The horse then ran between the fence and tree and Guy's leg hit the tree knocking him off the horse breaking his leg in his knee joint. Guy had to wear a cast for six weeks and then he was on crutches. It was weeks before he could bend his knee. At the time, he was in the ninth grade. Although he was promoted to the 10th grade, he did not return to school. Guy later completed the GED while stationed at Pawtucket River, Maryland. After his active military service ended in June 1974, Guy moved back to a home he and his wife Edna had built on a part of his father's farm in Ayden, North Carolina. His sister Inez lived beside of him and his mother lived on the other side of Inez. He then worked at M&W Chevrolet in Ayden from 1974 until 1980 as a mechanic and later as service manager. He then went to Phelps Chevrolet in Greenville, North Carolina as Service Manager where he worked until 1990. Guy then worked at KMART as service manager in their Automobile Service Center first in Greenville and later in Smithfield, North Carolina retiring in 1995. Guy loved to hunt and fish. He usually went hunting with his father when he visited his family in Ayden and fished a lot at the various Naval Bases he was stationed at. While he was stationed in Maryland, he owned an old wooden Bay Built boat with an inboard motor. He and his family both fished and gathered oysters off the boat in and around Harpers Creek on the Navy Base. One of his many fishing stories is about a time he and his son, Kenny, were fishing off the bridge at Harpers Creek. They were putting their fish on a stringer, tying one end off to the bridge and then lowering the fish to the water. After putting a fish on the stringer Kenny went back, to add another and the stringer and all of the fish were gone. Kenny was horrified and Guy was relieved not to have so many fish to clean! Guy also has fond memories of his parents visiting him and his family in Maryland. Although his father, Heber Warren Braxton, would not step foot on a boat, his mother, Sarah Olivia Dennis Braxton, loved to go out on the boat to fish and help gather Oysters. Unbelievably, she also enjoyed shucking Oysters. Years later, during the late 1970's and early 1980's Guy and Edna and their son Kenny and his wife Vickie owned a "get away" mobile home at Oriental, North Carolina. Kenny and Vickie docked their 21' Chrysler sail boat there and Guy left his 21' Sea Ox fishing boat there as well. Most weekends from Spring to Fall, they could be found somewhere on the Neuse River fishing and crabbing. Many exciting adventures were experienced by all during those years. On one such occasion, they were all "set net" fishing one late night. They all went out to check the nets and to their horror discovered, a horseshoe crab had been caught in the net. In what must have been a hilarious site to behold from afar, they proceeded to carefully remove what they thought was an extremely dangerous crab from the net. Everyone was scarred that it was going to take off his or her fingers or maybe an arm with its pincher claws. It was only years later that they discovered horseshoe crabs do not have claws or pinchers. It could not have hurt them even if it had wanted to! Of the many adventures, Guy has had fishing, the one that has been retold over the years the most is when he created what his family described as a new "Olympic Event". It happened on one bright sunny day at Oriental, North Carolina. Guy, Edna, Kenny, and Vickie had loaded up Guy's Sea Ox and taken off for a day of fishing and crabbing on the Neuse River. It was a bit windy and choppy that day on the Neuse. During one of Guy's trips to the liquid refreshments cooler, the rocking boat caused him to lose his balance and he dived bottom first into a cooler half filled with nervous and somewhat angry crabs. As we, all learned that day, its impossible to get a cooler off your butt, especially when everyone is laughing too hard to help! One of the events Guy occasionally held at his home that his son, Kenny, and his daughter-in-law, Vickie, always looked forward to was when Guy got the family together for one of his famous oyster steamings. Guy had an unusual setup for steaming oysters. He had a twenty-gallon barrel he boiled water in over an old gas-fired tobacco barn-curing burner. He would lower the oysters down above the boiling water in a large basket and steam them until they were perfectly cooked. Perhaps the most unusual part of his oyster steaming setup was his homemade oyster-shucking table. It consisted of an open top 55-gallon metal drum covered by a 4'x8' sheet of plywood with a hole cut out in the middle centered over the drum. Everyone gathered around the drum shucking oysters, dipping them in their favorite sauce, enjoying eating them, and then chasing them with their favorite beverage. Even folks who did not care for oysters enjoyed coming to the table and trying their hand at shucking oysters. And of course, there were always other delicacies such as steam shrimp, assorted vegetables, french fries, and anything else the family had requested. I get hungry just thinking about these great cookouts!6 |

(A supplemental registration was held on August 24, 1918, for those becoming 21 years old after June 5, 1918. This was included in the second registration.) The third registration was held on September 12, 1918, for men age 18 through 45. The armistice was signed November 11 1918. Heber registered during the third and final registration and due to the signing of the armistice two months later, he was not drafted.9 |

His entry is as follows: Heber, age 31, Farmer; Sarah, wife, age 31; Inez, daughter, age 4. Heber is recorded as renting his farm. It was also recorded that Heber and Sarah were 24 years of age when they married (we know from other records including marriage license and personal testimony by Sarah, she was 15 when they married). Both of them could read and write, and their parents were born in the North Carolina. Heber did not serve in the military. Heber's farm was recorded as farm number 23 on the farm schedule. Heber's entry is recorded in the Pitt County 1930 Federal Population Census for Ayden Township on Page 259 sheet 2A. Heber's parents, John Warren and Sarah Braxton, lived on the farm beside of him. .10 |
| Deed* | Heber bought property at Ayden, Pitt County, North Carolina, on 11/26/1952. After his mother, Sarah Marena McLawhorn Braxton, died on May 6, 1952, the family agreed to wait until after the growing season was over and the crops had been harvested before selling her land. Heber decided that after having farmed other people's land for many years he wanted to buy a 30-acre tract from his mother's estate. This land was located approximately 1/2 mile west of Ayden, North Carolina at the end of Second Street on Jolly Road. The land was originally deeded to Sarah by Theresa Anderson and was known as the Smith Farm. This deed is recorded in Greenville, North Carolina at the Pitt County Courthouse in Deed Book T-23, page 432. The land was adjacent to Franklin McLawhorn's land. Some of his brothers and sisters did not want Heber to buy the farm. Perhaps partially due to jealousy and they were concerned that if the public knew a family member wanted the land it could limit bidding and ultimately lower the final price. Heber asked a friend, N.L Bradshaw, to secretly bid on his behalf at the auction for this tract of land. N.L. was a salesman for Royster Fertilizer Company's Store in Ayden, North Carolina and Heber had bought fertilizer from him thru the years and they had become close friends. They had also been known to share a “pint” now and then. When the bidding started N.L was standing beside Heber, and also standing beside Heber was his son, Guy. N.L waited until it appeared that a final bid of $20,000 would purchase the farm before every placing a bid. At this point, Heber gave N.L. a nudge and he raised the bid to $20,100. No one raised the bid; long at last, Heber and Sarah owned the land Heber would actively farm until his late sixties. Then they leased the land and tobacco allotment to others as a source of income. This deed was recorded on November 26, 1952 in Greenville, North Carolina at the Pitt County Courthouse in Deed Book W-26, page 557. In order to buy the farm, Heber and Sarah borrowed $7,000 at 5 1/5% annual interest from S. M. Edwards, the local pharmacists. Payments were due annually starting on December 1, 1953, with the final payment being due on December 1, 1959. There was only one other stipulation in the deed; they were to carry at least $7,500 of insurance for the buildings. This deed was recorded on January 26, 1953 in Greenville, North Carolina at the Pitt County Courthouse in Deed Book Y-26, page 159. Out of the money, Heber and Leon received from their Mother's estate they each put up $7000.00 plus the $7000.00 they borrowed. Leon D. Braxton, Heber's brother also held an interest in the farm with Heber. However, this partnership did not work out to everyone's satisfaction and Leon sold his interest to Heber and Sarah on February 21, 1953 for $10 and other valuable considerations. This deed was recorded on February 21, 1953 in Greenville, North Carolina at the Pitt County Courthouse in Deed Book I-26, page 159. It has been suggested that additional cash traded hands without the scrutiny of the taxman. Heber borrowed an additional amount from Mr. Edwards to buy Leon's interest. The farm was passed down to Heber's son, Heber Guy Braxton and granddaughter, Marisa Lynn Davenport Forrest. Edward Whaley eventually bought out Marisa's share on September 9, 1992. Guy, for many years, continued to lease his share of the land and tobacco allotment to others. .11,12 |
| Newspaper Article* | The following Newspaper Article about Heber Warren Braxton was published on 08/22/1971 at Ayden, Pitt County, North Carolina. "Mr. and Mrs. Heber W. Braxton were honored on their golden wedding anniversary at an open house on Sunday, August 22, given by their children. The receiving line included the honored couple, their children, Mr. and Mrs. David E. Davenport and daughter, Marisa, and Mr. and Mrs. Heber Guy Braxton and children, Kenny, Marlene and Robert of Virginia Beach, Virginia. The house was decorated for the occasion in colors of gold, white and green. The living room was decorated for the occasion with arrangements of flowers where Mr. and Mrs. James E. Nelson presided over the quest register. Mrs. Charlie McLawhorn and Mrs. Jesse Corbett served cake and Mrs. Joseph Carter poured punch. The refreshments table was overlaid with a white lace and yellow cloth and adorned with a four tiered decorated anniversary cake and an arrangement of yellow flowers and candles and greenery. Mrs. Braxton was wearing a blue dress and a gold orchid corsage. Mr. and Mrs. Braxton renewed their vows with the Rev. C.H. Orman performing. Good-byes were said by Mr. and Mrs. J.J. Dennis to the approximately 120 quests who called. Gifts were displayed by Mrs. Jesse Carroll of Greenville." Article was published in the Greenville, North Carolina Daily Reflector.13 |
| Biography* | Heber and Sarah were farmers their entire life. First tenants farmers and then in 1952 they bought their own farm where they lived and farmed for the rest of their lives. In later years, Heber raised vegetables that he sold to the local grocery stores out of the back of his pickup truck. Once they retired, Heber and Sarah leased their land and tobacco allotment to others as a source of income. Heber may have been named after Heber Warren Braxton, the son of David Warren Braxton, who was the brother of Warren's father, John Warren Braxton. David's son's name was also Heber Warren Braxton and he died at age 2 in 1891. He is buried across the street from the Winterville Cemetery in Winterville, North Carolina. They also provided a home to Winnie Avery Nelson, age 17, the daughter of Butler and Lossie Avery. Shortly after her mother died, Winnie’s father abandoned her and her brothers. She had finished high school and was ready to enter East Carolina University in Greenville when this happened. Unfortunately, she was not able to complete her college plans. First, she lived with her mother's brother, Burnice Braxton, and after he beat her with a belt, she left. She then lived with Heber and Sarah until she married. Winnie had met their daughter, Inez, riding the bus from Ayden to Greenville and back each day. They both worked in Greenville and quickly became friends. Heber and Sarah offered her the opportunity to live with them. She paid a little rent and had a home. They remained close the rest of their lives and Winnie always referred to them as Aunt Sarah and Uncle Heb. According to his daughter-in-law, Edna Earl Pilgreen Braxton, Heber was always good to her and told her he loved her as much as his children; Guy and Inez. While Heb, Sarah, and their children, Inez and Guy, were living on the Will Woods farm in Bell Arthur, Pitt County, North Carolina, at age 43 Heb had a heart attack. The very same night, Sarah stepped off their six-foot high back porch and broke her leg. Heb was in the hospital for months and Sarah could not do anything for herself or family for weeks. During this time, his mother, Mammy, gave him two acres of tobacco to farm on her land in Ayden. When they moved to this farm, neither of them could look after themselves or their family. Heb's sister, Nell, came over and helped them until Sarah was back on her feet. After his heart attack, as Heb worked up his strength, his first job was driving his mother “Mammy” wherever she needed to go. From the summer of 1967, Heber's grandson, Kenny Guy Braxton, has fond memories of “helping” his grandfather farm. Kenny rode the bus from Jacksonville, Florida to Ayden, North Carolina to spend the summer with his grandparents. He “helped” by driving a tractor pulling a tobacco cart through the tobacco fields for the “primers” to put their tobacco in. Then he pulled the cart to the tobacco barn where he dropped it off and headed back to the field with an empty cart. One day, Kenny generated a little excitement. He drove the tractor too near a large ditch and the tractor slid in all but over-turning! Considering the situation, Heber took this near catastrophe in a reasonable manner. Another tractor was used to pull the tractor out of the ditch. There was a lot of speculation that Kenny was driving far too fast! Needless to say, Kenny was a lot more careful the rest of the summer!11 |
